| New customers require payment on or before delivery depending on delivery location/distance. New customer deliveries over 150 miles or a 2-hour drive may require a cashier check upon delivery or payment prior to delivery. Rancho Encino does offer 15- and 30-day terms to existing customers with positive payment history and credit application check. Rancho Encino reserves the right to revoke credit terms at any time due to late payments or insufficient funds and will notify the customer in writing of such action. Any payment declined due to insufficient funds will also incur a fee of $50.00 to be added to the total balance due. Payments are considered past due 15 days after the due date stated on the invoice unless other arrangements have been made between Rancho Encino and the customer. Past due amounts are subject to a 1.5% finance charge per month or maximum lesser rate permitted by law |

All prices listed and advertised reflect cash payment discounts. Checks, cashier’s checks, and wire transfers are considered cash payments. 4% of full price, including shipping and tax (if applicable), will be added to all credit card payments. Pay with Cash and Save! Prices reflect wholesale trade only and are subject to change without notice. A 50% non-refundable deposit is required for tagging trees with a delivery date over 21 days unless otherwise arranged by Rancho Encino. If at any time the deposit becomes insufficient Rancho Encino reserves the right to remove tags and place them back in inventory to sell. Customers will incur a monthly maintenance fee of $18 per tree for deliveries not made within 30 days of the original delivery date. |
DELIVERY |

Rancho Encino provides delivery for customers with our trucks charged at $1.85/per mile and is calculated for round trip mileage. It is the customer’s responsibility to provide adequate manpower and equipment to unload trees safely, once unloading begins customer assumes liability. If an order is paid on delivery, unloading will not begin until the driver has received payment. Rancho Encino drivers are not responsible for unloading and if drivers must wait an excessive amount of time for unloading customers will be billed at $60 per hour after the scheduled delivery time. Rancho Encino will notify customers as soon as possible if our drivers are experiencing any delays. The minimum order amount for delivery may be based on delivery location. |
CLAIMS, LIABILITY & WARRANTY |

Rancho Encino gives no warranty, expressed, nor implied. Including no warranty on the longevity or productivity of trees. Any claims should be made in writing within 24 hours of receiving material and liability is limited to the purchase price. Claims are considered only on fully paid orders. The buyer agrees to pay reasonable attorney fees and other costs incurred for collection. Purchasing material from Rancho Encino constitutes acceptance of all terms and conditions stated. |
